Ana Gerdau de Borja Mercereau is a lawyer specializing in international arbitration, mediation and dispute boards.
Admitted to the Brazilian Bar in 2006 and to the Portuguese Bar in 2008, Ana Gerdau de Borja Mercereau has practiced at Wald from 2010 to 2015 (a Brazilian first-tier firm according to Legal500). In 2015 she joined Cleary Gottlieb Steen & Hamilton in Paris. Since 2017 she has worked as an independent international disputes practitioner in Paris.
Ana Gerdau de Borja Mercereau acted as counsel to a State in an investment arbitration under the ICSIS Rules, and to companies in more than 20 commercial arbitrations under ICC, ICDR/AAA and Brazilian rules such as CAM-CCBC, CCMA CIESP/FIESP, Câmara FGV and CAM-BM&FBOVESPA. She appeared in several cases such as major Brazilian infrastructure projects (in the construction, renewable energy, oil & gas and transportation sectors), M&A and mining projects. They included the world’s largest meat processing company, one of the largest French mass retailers, a leading Scandinavian energy investor, Brazilian leading oil & gas players, one of the world’s largest sports company, and a major Brazilian railway concessionary. She also worked as secretary of several arbitral tribunals.
Publications
Ana Gerdau de Borja has more than 30 publications on international and domestic arbitration, including a book published by Kluwer Law International entitled “Investment Protection in Brazil” (2014, with D Levy and A Pucci). Her PhD thesis “Regional Economic Community Rules and Investment Arbitration” at the University of Cambridge was supervised by ICJ Judge James Crawford.
