What Expert Determination is

A binding technical ruling from a genuine sector specialist.

Expert Determination is a private dispute resolution process where an independent expert — appointed for their professional knowledge, not just their legal qualification — examines a specific technical question and issues a binding decision. Both parties agree in advance to be bound by the expert's ruling.

It is particularly effective for disputes where the central question is technical rather than legal: what is the fair market value of this asset? Does this construction work meet the specification? Is this software compliant with the agreed performance standard? These questions are better answered by an engineer, valuer, or technical specialist than by a lawyer.
